¶1It has been brought to our notice that the application under Rule 40 (h) of the U.P. Minor, Minerals (Concession) Rules, 1963 has been dismissed on 21.8.2021. We find that this order has not been challenged.

¶2Learned Senior Counsel for the petitioner Sri C.L. Pandey assisted by Sri Durlabh Pandey, Advocate prays that this writ petition be dismissed and liberty be granted to the petitioner to challenge the order passed under Rule 40 (h) of the U.P. Minor, Minerals (Concession) Rules, 1963.

¶3Learned counsel for the opposite party does not oppose the prayer.
