¶1Heard Shri Dharmendra Pratap Singh, learned counsel for the petitioner and Shri S.C. Upadhyay, learned Standing Counsel for the State-respondents.
¶2By means of the present writ petition, the petitioner has prayed for a direction in the nature of mandamus directing the respondents specially respondent nos. 2 and 3 to take legal action against the respondent nos. 5 to 7 on the basis of inquiry report dated 01.07.2023.
¶3The petitioner who is a member of Gram Panchayat/ complainant lodged the complaint against some work which was performed. As certain work was performed by the District Level Officers in the Financial Year 2021, there were several financial irregularities done by the respondent no. 5 to 7 in his village, regarding which, a complaint was made. Regarding the financial irregularities done by the respondents, the said complaint was entertained and the Khand Vikas Adhikari had submitted a detailed report dated 21.10.2023 to the Chief Development Officer, Fatehpur. Learned counsel for the petitioner states that District Panchayat Raj Officer, Fatehpur has also issued notice to the Village Panchayat Officer. He further states that even though, the notices have been issued but later on, the respondents had not taken any steps even to recover or to penalise the persons who were involved in the financial irregularities. Such situation impelled the petitioner to approach to this Court with the grievance. Even though, the inquiry has already been finalised but till date, the authority has not proceeded in the matter.
¶4Considering the facts and circumstances, we are not inclined to keep the matter pending consideration. With the consent of the counsel for the parties, we dispose of the writ petition asking the District Magistrate, District-Fatehpur to look into, consider and proceed in the matter strictly in accordance with law, expeditiously, preferably within a period of six weeks from the date of production of certified copy of this order but after giving an opportunity of hearing to the respondents, specially respondent nos. 5 to 7.
