¶1Heard learned counsel for the applicant and learned A.G.A. for the State.

¶2The instant application under Section 482 Cr.P.C. has been preferred by the applicant with prayer to direct the Commissioner, Kanpur Division, Kanpur to decide the Appeal No. 1900 of 2023 (Aditya Kumar Shukla Vs. Additional District Magistrate (Finance & Revenue), Kanpur Dehat), under Section 6 of the Uttar Pradesh Control of Goondas Act, 1970 (hereinafter, referred to as, 'Act of 1970'), Police Station-Gajner, District-Kanpur Dehat, pending before the court of Commissioner, Kanpur Division, Kanpur within stipulated period.

¶3It is submitted by the learned counsel for the applicant that proceeding under Section 3(1) of the Act of 1970 was initiated against the applicant, in which externment order for a period of six months has been passed on 20.04.2023 by Additional District Magistrate (Finance & Revenue), Kanpur Dehat. It is next submitted that against the said order, applicant has preferred aforesaid appeal under Section 6 of the Act of 1970 before the Commissioner, Kanpur Division, Kanpur on 28.08.2023, but the same is still pending.

¶4Considering the facts of the case as noted above, Commissioner, Kanpur Division, Kanpur is directed to decide the Appeal No. 1900 of 2023 within one month from the date a certified copy of this order is produced before him.
