And Another Counsel for Applicant :- Prabhu Narain Srivastava,Rajesh Chandra Sinha Counsel for Opposite Party :- G.A.,Nagendra Kumar,R.K. Mishra Hon'ble Krishan Pahal,J.
¶1List has been revised. None has appeared to press this bail cancellation application on behalf of the applicant. Sri R.K. Mishra, learned counsel for opposite party no.2 and Sri Ashwani Kumar Tripathi, learned A.G.A. for the State are present. In the circumstances, I myself have perused the record.
¶2The instant bail cancellation application was filed on 29.5.2023. None was present on behalf of the applicant on the last two occasions also i.e. on
31.10.2023 and 22.11.2023. It cannot be allowed to swing years together in the cloak of pendency.
¶3The Apex Court in Ishwarlal Mali Rathod v. Gopal, (2021) 12 SCC 612 has categorically held that courts shall not grant the adjournments in routine manner and mechanically and shall not be a party to cause for delay in dispensing the justice.
¶4It appears that the applicant has lost interest in pursuing the matter. Therefore, by the efflux of time, it seems to have been rendered infructuous.
¶5The application is accordingly dismissed as infructuous. Order Date :- 14.12.2023 Vikas [Krishan Pahal, J.] High Court of Judicature at Allahabad
