Court No. - 40 Case :- WRIT - C No. - 38800 of 2023 Petitioner :- Bijendra Pal Soni And 4 Others Respondent :- State Of U.P. And 15 Others Counsel for Petitioner :- Shree Prakash Giri Counsel for Respondent :- CSC,Ravi Anand Agarwal,Suresh C. Dwivedi,Tanisha Jahangir Monir Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Prashant Kumar,J.
¶1Heard Sri S.P. Giri, learned counsel for the petitioners, learned standing counsel for the State respondents, Sri S.C. Dwivedi, learned counsel for Agra Development Authority and Sri R.A. Agarwal, learned counsel for the Nagar Nigam, Agra.
¶2In the present writ petition sole allegation is that the respondent authorities are proceeding against the petitioners for carrying out the demolition without due process of law.
¶3In this backdrop, we have asked Sri S.C. Dwivedi, learned counsel for Agra Development Authority to seek instructions in the matter. He has placed categorical instructions dated 14.12.2023, which indicates that the construction is without any sanctioned map but at the same time it is also stated that the respondents are not carrying out any demolition.
¶4Once the categorical instructions are received, we are not inclined to proceed further in the matter. Needless to say the authorities are at liberty to proceed strictly in accordance with the provisions of U.P. Urban Planning & Development Act 1973.
¶5With the aforesaid observations, the writ petition stands disposed of.
¶6The instructions dated 14.12.2023 are taken on record. Order Date :- 14.12.2023 S.P. High Court of Judicature at Allahabad
