¶1Heard learned counsel for the applicant and learned A.G.A. for the State of U.P.

¶2The instant application under Section 482 Cr.P.C. has been preferred by the applicant, who is husband of opposite party No. 3 (Rakhshinda Jabi) with prayer to issue direction to the Principal Judge, Family Court, Gyanpur Bhadohi to decide application bearing No. 72B dated 08.05.2023 filed in Case No. 75 of 2017 (Rakhshinda Jabi Vs. Jamshed Khan) within stipulated time.

¶3At the outset, learned A.G.A. pointed out that this is second application under Section 482 Cr.P.C. for the same relief, which is not maintainable. The first application under Section 482 Cr.P.C. filed by the applicant has been dismissed as withdrawn without granting liberty vide order dated 06.09.2021 in Application under Section 482 No. 15391 of 2021.

¶4In response, learned counsel for the applicant does not dispute the aforesaid fact.
