¶1The grievance of the petitioner in the present petition is that his first appeal registered u/s 6 of U.P. Janhit Guarantee Adhiniyam, 2011, regarding his scheduled caste certificate is not being decided by the Sub-Divisional Magistrate, Kirawali, District-Agra i.e. respondent no. 4 despite order dated

27.9.2023 passed by the Additional District Magistrate (City), District-Agra. By the aforesaid order, the Additional District Magistrate (City), District-Agra had directed the Sub-Divisional Magistrate, Kirawali, District-Agra to expeditiously decide the appeal filed by the petitioner.

¶2The petitioner may file an application before the Additional District Magistrate (City), District-Agra bringing on record all necessary facts to his notice and on receiving the said application, the Additional District Magistrate (City), District-Agra shall ensure that the first appeal filed by the petitioner u/s 6 of U.P. Janhit Guarantee Adhiniyam, 2011, pending before the Sub-Divisional Magistrate, Kirawali, District-Agra is decided expeditiously.

¶3It is clarified that the Sub-Divisional Magistrate, Kirawali, District-Agra, shall also consider the maintainability of the first appeal.
