Judgment
Court No. - 34 Case :- WRIT - A No. - 20681 of 2023 Petitioner :- Jagpal Singh Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Ishir Sripat,Saurabh Patel Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J. Heard Sri Ishir Sripat, learned counsel for the petitioner as well as learned Standing Counsel. It is submitted that the petitioner who is working as sub Inspector in Local Intelligence Unit (L.I.U.), Rampur was served with a show cause notice for wrongful fixation of pay on account of certain benefits under the Assured Career Progression (A.C.P.) Scheme. This show cause notice dated 31.07.2023 stated to have been replied too duly by the petitioner within time on 07.08.2023 but no decision has been taken in the matter and yet the respondents have proceeded to reduce pay of the petitioner. Per contra it is argued by learned Standing Counsel that no such action has been taken till date rather the Finance Controller of Police Head Quarters has been directed to take sympathetic consideration in the matter of reply of the petitioner to the show cause notice as is indicated in the letter of Superintendent of Police, Rampur dated 27.09.2023 which has been brought on record as Annexure No. 5 to the writ petition. In such above view of the matter, I consider it more appropriate at this stage to direct the Finance Controller, Police Head Quarters, U.P., Lucknow to take appropriate decision in the matter of show cause notice and the recommendation made by the Superintendent of Police on 27.09.2023 as expeditiously as possible preferably within a period of 30 days from the date of receipt of certified copy of this order. It is expected therefore, that the show cause notice shall be acted upon only after the final orders are passed by the authority. Needless to add that the order to be passed by the competent authority, as directed herein above, shall be reasoned and speaking one. With the aforesaid observations and directions, this petition stands disposed of. Order Date :- 14.12.2023/IrfanUddin High Court of Judicature at Allahabad
