CAPL 5871/2023

Judgment

Court No. - 9 Case :- CONTEMPT APPLICATION (CIVIL) No. - 5871 of 2023 Applicant :- Hari Ram And 3 Others Opposite Party :- Sri Sheelvant, Civil Judge (Senior Division) And 2 Others Counsel for Applicant :- Yogesh Kumar Vaish,Akhilesh Kumar Pandey Hon'ble Rohit Ranjan Agarwal,J. In Second Appeal No. 120 of 2021 the Court on 28.11.2022 granted an interim order directing the parties therein not to create any third party interest over the property in dispute. From perusal of the parties arrayed in second appeal as well as parties to the Original Suit No. 320 of 1994 from which the appeal has arisen, and the parties in the contempt application, it transpires that the present contemnors are not the party either in original suit or in second appeal, which is pending before this Court. As the contemnors/opposite parties are not the party in second appeal, the injunction order granted by the appellate Court will not be applicable upon them. No case for contempt is made out. Contempt application is misconceived and dismissed, accordingly. Order Date :- 14.12.2023 Shekhar High Court of Judicature at Allahabad
