¶1Prayer made in the instant petition is for a direction to the respondents to release compensation amount along with interest in favour of the petitioners in compliance of judgment and decree dated 26.3.1991 and 27.4.1991 passed by IVth Additional District Judge, Allahabad in a reference under Section 18 of the Land Acquisition Act, 1894.

¶2The Prayagraj Development Authority (respondent no. 5) who is the beneficiary of the acquisition proceedings has submitted written instructions according to which, it is ready to pay the compensation amount to the petitioners as soon as the amount payable under the order and decree of the reference court is informed to it.

¶3Sri Rajeev Gupta, learned Additional Chief Standing Counsel, is in receipt of instructions from Special Land Acquisition Officer, Prayagraj according to which the amount has been calculated and has been communicated to the Secretary, Prayagraj Development Authority vide order dated 12.12.2023.

¶4Having regard to the aforesaid facts, we dispose of the instant petition with direction to respondent nos. 3 and 5 to ensure that payment of the compensation amount is made to the petitioners within three weeks from the date of communication of the instant order. In case there is any error in the calculation, it is left open to the petitioners to accept the money under protest and take appropriate proceedings for rectification. (Kshitij Shailendra, J.)
