Heard learned counsel for the petitioner and learned A.G.A. for the State. The instant writ petition seeks following relief:- "A. Issue a writ, order or direction in the nature of mandamus directing the respondent to release the house of the petitioner which was seized under section 14(1) of U.P. Gangster Act, while the petitioner has never been prosected by the State." The petitioner is aggrieved by the order passed by the District Magistrate on 19.6.2023 whereby his representation under the Gangsters Act has been rejected and the matter has been referred to the court as provided under the Act. Since the matter has been referred to the competent court, as is the requirement under the Act, no case for interference is made out. The petition is disposed of with a direction to the court concerned to decide the matter as regards the claim of the petitioner, as expeditiously as possible, without granting unnecessary adjournment to any of the parties.
