Court No. - 44 Case :- MATTERS UNDER ARTICLE 227 No. - 12643 of 2023 Petitioner :- Smt. Gauri Bharati And 12 Others Respondent :- Sri Ramjeet And 5 Others Counsel for Petitioner :- Rahul Singh,Ranjeet Asthana Hon'ble Ashutosh Srivastava,J. Heard Shri Rahul Singh, learned counsel for the petitioners. Considering the nature of the order that is proposed to be passed notice upon the respondent nos. 1 to 6 is being dispensed with. The present petition, under Article 227 of the Constitution of India, has been filed for a direction to the Additional District Judge, Ist Ghazipur, to expedite the disposal of the Civil Revision No. 133 of 2016, Sri Ramjeet and others vs. Smt. Gauri Bharati and others, which is stated to be pending since the year 2016, within a time frame fixed by this Court. Learned counsel for the petitioner submits that the petitioners are respondent in the aforesaid revision and the Court below has granted interim order in favour of the revisionist/ respondent herein. He submits that the petitioners have already put in appearance in the aforesaid revision and filed their objections etc. However, despite various dates being fixed, for disposal of the Revision, the same is still pending since last 7 years and in such circumstances submits that a direction for expeditious disposal of the revision proceedings may be directed. I have heard learned counsel for the petitioners and perused the record. From the order sheet, brought on record as annexure no. 2 to the petition, the Court finds substance in the submissions advanced by the learned counsel for the petitioners and in the opinion of the Court the ends of justice would stand subserved if directions are issued for expeditious disposal of the Civil Revision. Accordingly, the petition is disposed off by directing the Additional District Judge, Ist, Ghazipur, in seisin of the proceedings of the Civil Revision No. 133 of 2016, Sri Ramjeet and others vs. Smt. Gauri Bharati and others, to conclude and decide the same, expeditiously, preferably, within a period of three months from the date of service of certified copy of the order of this Court, in accordance with law, without granting unnecessary adjournments to either of the parties.
