¶1Heard Shri Yashwant Singh, learned counsel for the petitioner and Shri Ratan Singh, learned AGA appearing for the State respondents.

¶2Present petition has been filed seeking a direction in the nature of mandamus commanding the respondents no.2 and 3 to conduct fair and proper investigation in case crime no.860 of 2023, under sectios 302, 504 IPC and Section 3(2)(v) of the S.C./S.T. Act, Police Station Kotwali Kannauj, District Kannauj.

¶3After some arguments, learned counsel for the petitioner submitted that he may be permitted to withdraw the present petition with liberty to avail the remedy as may be available to the petitioner in accordance with law.

¶4Accordingly, present petition stands dismissed as withdrawn with liberty to the petitioner to avail the remedy as may be available to the petitioner under section 156(3) Cr.P.C., if needs so arise in future. Order Date :- 15.12.2023 Nitendra High Court of Judicature at Allahabad
