¶1The instant petition has been filed praying for a writ of mandamus commanding the respondents to pay compensation to the petitioners for having acquired its land bearing Arazi No. 680 area 0.4150 hectare situated in village Nepal, Tehsil and District Firozabad.

¶2Admittedly, the aforesaid land of the petitioners was acquired under the provisions of National Highway Act, 1956. The petitioners have annexed Notification dated 17 April, 2013 under section 3 D. However, the petitioner has nowhere disclosed in the writ petition whether any award has been made sofar or not.

¶3Since, the aforesaid crucial fact has not been clarified, therefore, we are not ready to accept that the compensation amount has not been determined.

¶4We leave it open to the petitioners to approach the Competent Authority for redressal of their grievance in relation to the payment of compensation for the acquired land.
