The applicants before this Court had filed a claim petition before Motor Accident Claims Tribunal, Mathura being M.A.C. No.61 of 2017. The claim petition was decided on 27.08.2021. Aggrieved by the said order, a First Appeal From Order No.302 of 2022 was filed by the applicants. The said appeal was partly allowed on 30.09.2022 enhancing the awarded amount. Present contempt application has been filed under Section 12 of Contempt of Courts Act, 1971 for punishing the opposite party for non-compliance of order dated 30.09.2022 passed in First Appeal From Order No.302 of 2022. As the applicants have a remedy of filing an execution case for executing the award under the Motor Vehicle Act, 1988, no case for contempt is made out.
