Judgment
Court No. - 39 Case :- WRIT - C No. - 42347 of 2023 Petitioner :- Smt. Vidhyavati Devi Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Dinesh Kumar Singh Counsel for Respondent :- C.S.C. Hon'ble Saumitra Dayal Singh,J. Hon'ble Shiv Shanker Prasad,J.
¶1Having heard Mr. Dinesh Kumar Singh, learned counsel for the petitioner and Mr. Arimardan Singh Rajpoot, learned Additional Chief Standing Counsel for the State-respondents, no interference may be made in the present writ petition, as the petitioner is seeking payment of interest on the alleged delayed payment/short payment of rent.
2.Admittedly, the petitioner had let out his premises to the government agencies. Presently, the same has been vacated on 28th December, 2020.
¶3In such fact, whatever further claim, the petitioner may make, may remain open to be tested in proceeding under common law.
¶4The present writ petition is wholly misconceived and in any case, we are not inclined to offer any interference in exercise of our extraordinary jurisdiction under Article 226 of the Constitution of India, in such facts that are inherently disputed.
¶5Accordingly, the present writ petition is dismissed. (Shiv Shanker Prasad, J.) (Saumitra Dayal Singh, J.) Order Date :- 15.12.2023 Sushil/- High Court of Judicature at Allahabad
