Judgment

Court No. - 39 Case :- WRIT - C No. - 41559 of 2023 Petitioner :- Ramesh And 24 Others Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Sanjay Singh,Shivam Singh Counsel for Respondent :- C.S.C. Hon'ble Saumitra Dayal Singh,J. Hon'ble Shiv Shanker Prasad,J.

¶1Having heard Mr. Sanjay Singh, learned counsel for the petitioners and Mr. Mukul Tripathi, learned Standing Counsel for the State-respondents, it transpires that at present, the petitioners are visited with the individual notices issued by the Ziledar, Minor DaaL Canal Division, Ghazipur (respondent no.3). The petitioners have been called upon to explain why the encroachments may not be removed.

¶3Facts are unascertain and no jurisdictional error is shown to have been committed by the respondent in issuance of impugned notices.

¶4Accordingly, interference claimed is declined, at this premature stage.

¶5The present writ petition is disposed of with the observation, in case the petitioners file their individual objections/replies to the notices received by them, within a period of two weeks from today along with a copy of this order, those proceedings may be concluded, by means of a reasoned and speaking order, as expeditiously as possible, preferably within a period of one month from the date the compliance is shown by the petitioner.
