¶1Heard Mr. Prabha Shanker Pandey, learned counsel for the petitioner and Mr. Arimardan Singh Rajpoot, learned Additional Chief Standing Counsel for the State-respondents.

¶2Solitary grievance of the petitioner is the pendency of his applications dated 25 September, 2023 and 26th September, 2023 filed before the District Magistrate, Banda (respondent no.2). Reference has also been made to the endorsement made by the District Magistrate, Banda dated 29th September, 2023 requiring the Sub-Divisional Magistrate, Tehsil Atarra, District-Banda (respondent no.3) to make due verification and submit report.

¶3In the above context, it has been asserted, action is not being completed and the complaint of the petitioner has not been brought to its logical end by the State-respondents. Undue delay is being caused to the prejudice of the petitioner.

¶4Without entering into the merits of the complaint, insofar as it is not disputed that the petitioner has filed the application on which the District Magistrate has called for a report and those proceedings appear to be pending, we dispose of the present writ petition with the direction upon the District Magistrate to make due verification and pass appropriate reasoned order, in terms of the Government Policy with respect to land mafias and other illegal occupants of private land. Such action may be completed preferably within a period of three months from the date a copy of this order is filed before that authority. (Shiv Shanker Prasad, J.) (Saumitra Dayal Singh, J.)
