Case no.
WPIL 2713/2023

Judgment

Court No. - 21 Case :- PUBLIC INTEREST LITIGATION (PIL) No. - 2713 of 2023 Petitioner :- Lallu Singh Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Shiv Narayan Pandey,Pramod Kumar Tripathi Counsel for Respondent :- C.S.C. Hon'ble Manoj Kumar Gupta,Acting Chief Justice Hon'ble Kshitij Shailendra,J.

¶1The prayer made in the instant petition purportedly filed in public interest, is for a direction to respondent nos. 2 and 3 to decide the grievance of the petitioner in a stipulated time.

¶2The petitioner alleges that one Anil Pathak, Assistant Development Officer, who was appointed as Administrator during election period, had indulged in corruption in discharge of his official functions. The petitioner wants that technical evaluation of the works executed during his tenure be made by some honest Magistrate.

¶3It is noteworthy that the previous writ petition filed by the petitioner for the same relief was dismissed by order dated 16.11.2023, as he had not made due disclosures of his credentials, as required under sub-rule (3-A) of Rule 1 of Chapter XXII of the Allahabad High Court Rules, 1952.

¶4Once again, the petitioner has not disclosed his credentials except for making a bald assertion that he is a social worker and RTI activist.

¶5We are not satisfied with the credentials and bonafides of the petitioner in filing the present writ petition. Moreover, Anil Pathak, against whom the petitioner wants an enquiry to be held, has also not been arrayed as a party to the instant petition.

¶6For the aforesaid reasons, the petition is dismissed. (Kshitij Shailendra, J.) (Manoj Kumar Gupta, A.C.J.) Order Date :- 16.12.2023/Jaideep/- High Court of Judicature at Allahabad
