¶1Heard learned counsel for the petitioner and learned Standing Counsel for the State.

¶2In face of allegation of infringement of trade mark claimed by the petitioner, it is left open to the petitioner to avail appropriate remedy under the Trade Mark Act, 1989 and/or any other law of which benefit may be claimed by the petitioner.

¶3Insofar as the criminal offence is concerned, the writ Court may remain disinclined to issue any positive direction to the State functionaries to act one way or other, where facts are uncertain.
