Sri Mohammad Aslam Beg, learned counsel for the petitioners and Ms. Isha Mittal, learned Standing Counsel for the State and its authorities. The petition involves disputed questions of facts, which cannot be gone into in a petition filed under Article 226 of the Constitution of India. Moreover, counsel for the petitioners admits that after filing of this writ petition, the State has preferred a revision before the Board of Revenue, which is pending. In view of above developments, present petition, in its present form, is not maintainable and the same is, therefore, dismissed, leaving it open to the petitioners to avail remedy available to them under the law and, if they so desire, to move an application for early disposal of the pending case.
