From the pleadings and documents filed in support of the writ petition, there appears a dispute between two private parties. In the given facts and circumstances of the case and further considering the fact that the matter may require to lead evidence to determine the disputed questions of facts, which cannot be gone into in a petition filed under Article 226 of the Constitution of India, without interfering or commenting on the subject matter, the petition is disposed of, leaving it open to the petitioners to avail the remedy available to them under the law. From the record, it further transpires that proceedings under Section 133 Cr.P.C. have already been initiated. In such circumstance, the petitioners would be at liberty to pursue the said remedy and file an application seeking urgent disposal of the case.
