A preliminary objection has been raised by the State counsel that for the same subject matter, a Writ-C petition has already been filed at Allahabad by the petitioner and this petition is not maintainable, which has been filed suppressing the material fact. Counsel for the petitioner submits that he may be permitted to withdraw this writ petition. The petition is, accordingly, dismissed as withdrawn. It is made clear that, in case, such a petition has been filed and is pending at Allahabad, the petitioner is obliged to make a specific pleading in the said petition by way of an amendment, informing the Court at Allahabad about the dismissal of this writ petition here at Lucknow.
