Court No. - 8 Case :- WRIT - A No. - 3831 of 2023 Petitioner :- Narayan Kumar Respondent :- Union Of India Thru. Its Secy. Postal And Telegraph Deptt. And 2 Others Counsel for Petitioner :- Rajesh Kumar Singh,Shesh Mani Counsel for Respondent :- A.S.G.I. Hon'ble Dinesh Kumar Singh,J.

¶1Heard learned counsel appearing for the petitioner and Sri Varun Pandey, learned Counsel appearing for the Union of India.

¶2Present petition under Article 226 of the Constitution of India has been filed for a writ in the nature of certiorari to quash the order dated

28.04.2023 passed by Superintendent of Post Office Bahraich Division, Bahraich whereby the petitioner's application form "GDS Online Engagement Cycle-V-2023" has been cancelled as there were discrepancies in the application form and documents submitted by the petitioner for verification.

¶3The petitioner mentioned that he passed out High School from Board of High School and Intermediate Education, U.P., Allahabad whereas in the mark-sheet submitted by him during the documents verification, name of Board was 'U.P. State Open School Board'. As the petitioner filled up wrong information in the form, his candidature has been cancelled.

¶4It is important to note here that instructions were issued along with advertisement inviting application for engagement of Gramin Dak Sevaks

(GDS) vide notification 17-21/2023-GDS on 27.01.2021.

¶5In the instructions, it is specifically provided that the application can be submitted online, and applications received from any other mode shall not be entertained. Applicants would be shortlisted for engagement on the basis of a system generated merit list, which was to be prepared on the basis of marks obtained /conversion of Grades/Points to marks in Secondary School Examination of 10th standard of approved Boards aggregated to percentage to the accuracy of 4 decimals. Passing of all the subjects as per the receptive approved board norms was mandatory.

¶6As the petitioner made wrong declaration in the application form in respect of Board from where he passed out the High School Examination, his candidature has been cancelled. I find that the authorities concerned has not committed any error, which requires any interference by this Court in exercise of its jurisdiction under Article 226 of the Constitution of India. The petition lacks merit and is hereby dismissed. (Dinesh Kumar Singh, J.) Order Date :- 23.5.2023 prateek High Court of Judicature at Allahabad, Lucknow Bench
