Court No. - 8 Case :- WRIT - A No. - 1624 of 2023 Petitioner :- Awdhesh Kumar Respondent :- State Of U.P. Thru. Prin. Secy. Medical And Health Dept. Lko. And 5 Others Counsel for Petitioner :- Mohd. Ateeq Khan Counsel for Respondent :- C.S.C.,Umesh Chandra Pandey Hon'ble Dinesh Kumar Singh,J.
¶1Heard learned counsel for the petitioner as well as Mr. Ram Pratap Singh Chauhan, Chief Standing Counsel, for respondents-State Authorities.
¶2This petition under Article 226 of the Constitution of India has been filed by the petitioner, being aggrieved from the order dated 29.11.2022 whereby the Chief Medical Officer, Santkabir Nagar, has posted the petitioner to Community Health Center, Semariyawan, Santkabir Nagar as Chief Pharmacist.
¶3The petitioner was transferred from Maharshi Vashishtha Swashi Mahavidyalay, Basti to the office of the Chief Medical Officer, Santkabir Nagar. It is the responsibility and within jurisdiction of the Chief Medical Officer to deploy the work-force available within his district at appropriate places. The petitioner cannot choose that he should be posted at a particular place in Santkabir Nagar. The Chief Medical Officer has posted him at Community Health Center, Semariyawan on a vacant post of Chief Pharmacist. I do not find that the impugned order suffers from any illegality or it is in violation of the service rules of the petitioner.
¶4In view thereof, this petition, being devoid of merit and substance, is hereby dismissed. [D.K. SINGH,J.] Order Date :- 24.5.2023 MVS/- High Court of Judicature at Allahabad, Lucknow Bench
