¶1Though the matter is listed peremptorily, however, none has put in appearance on behalf of the petitioner to press this petition.

¶2Heard Mr. Prafull Kumar Yadav, learned Additional Chief Standing Counsel, representing the respondents-State Authorities.

¶3This petition under Article 226 of the Constitution of India has been filed, seeking quashing of the order dated 04.08.2022, Annexure-1, by means of which the petitioner was placed under Suspension.

¶4This Court had stayed operation and effect of the suspension order dated 04.08.2022 vide interim order dated 14.09.2022, and the interim order has remained in operation throughout. In the meantime, the inquiry officer concluded the inquiry and submitted its report dated 25.04.2023 to the State on

17.05.2023. The State Government has not passed the final order.

¶5In view thereof, the competent disciplinary authority is directed to take a final decision within two months from today.

¶6Till the final decision is taken, the impugned suspension order dated 04.08.2022 shall not be given effect to.
