¶1Heard Mr. Pradeep Kumar Singh Vats, learned counsel for the petitioner, Mr. S.B. Pande, learned Senior Advocate/Deputy Solicitor General of India, assisted by Mr. Deepanshu Das, Advocate for respondent nos. 1 and 2, as well as Mr. Uttam Kumar Srivastava, learned Standing Counsel, for respondent no. 3.

¶2The petitioner is seeking re-determination of his seniority to the cadre of IPS.

¶3Under Section 14 of the Administrative Tribunals Act, 1985 (for short "Act, 1985"), the statutory forum (Central Administrative Tribunal) has been created for adjudication of such disputes in respect of All India Services, including IPS.

¶4Learned counsel for the petitioner does not dispute that the forum, constituted under the Act, 1985, is competent to adjudicate the dispute.

¶5In view thereof, the present petition is allowed to be withdrawn by the petitioner to approach the CAT for the reliefs sought by moving an original application. If such an original application is moved within ten days from today, the same shall be decided by the CAT expeditiously, preferably within a period of four months thereafter inasmuch as the learned counsel for the petitioner submits that the issue is covered by two judgments of different High Courts i.e. one by Karnataka High Court and one by Delhi High Court.
