Judgment

Court No. - 21 Case :- WRIT - C No. - 1001337 of 2005 Petitioner :- Rajendra Kumar Nigam Respondent :- District Judge Lucknow And 2 Others Counsel for Petitioner :- Brijesh Kumar Saxena Counsel for Respondent :- C.S.C.,R.K. Nigam Hon'ble Dinesh Pathak,J.

¶1Instant writ petition has been filed assailing the order dated

25.10.2004 passed by the learned District Judge in appeal, arising out of final decree dated 16.05.2002, by which appeal has been ordered to be registered as a regular civil appeal.

¶2While entertaining the instant writ petition notices were ordered to be issued. However, there is no order with regard to staying the further proceedings going on in appeal pending consideration, at that time, before learned district judge.

¶3It appears that till now the appeal must have been decided by the learned district judge in absence of any interim order staying the proceeding before him. Instant writ petition appears to have become infructuous by efflux of time.

¶4As such, instant writ petition is dismissed as infructuous. Order Date :- 31.5.2023 Pkb/ High Court of Judicature at Allahabad, Lucknow Bench
