Judgment
Court No. - 8 Case :- WRIT - A No. - 4408 of 2023 Petitioner :- Ajay Kumar Singh Respondent :- State Of U.P. Secy. Deptt. Of Secondary Edu. Lko And 4 Others Counsel for Petitioner :- Arunendra Nath Mishra Counsel for Respondent :- C.S.C. Hon'ble Dinesh Kumar Singh,J.
¶1Heard Sri Arunendra Nath Mishra, learned counsel for the petitioner and Sri Diwakar Singh, learned Standing Counsel.
¶2The present writ petition under Article 226 of the Constitution of India has been filed impugning the order dated
27.12.2022, whereby the petitioner's request for changing the pension papers for full pennon instead of 40% commutation, has been rejected on the ground that the petitioner while applying online, has requested for 40% commutation of pension, whereas in offline form, which was submitted later on, the petitioner has not claimed any commutation of pension.
¶3The petitioner himself has submitted the online form with the petition as Annexure-5. The online form would clearly disclose that the petitioner has requested for 40% commutation of his pension. After filling the aforesaid form, 40% commutation of his pension has been credited to the account of the petitioner. The petitioner has, thereafter, changed his view, but by that time 40% commutation of pension has already been paid to the petitioner.
¶4In view thereof, I find no substance in the present writ petition, which is hereby dismissed. Order Date :- 31.5.2023 Rao/- High Court of Judicature at Allahabad, Lucknow Bench
