This writ petition has been filed with the prayer to quash the First Information Report registered as Case Crime No.0412/2023, under sections 420, 406 I.P.C. Police Station-Kotwali, District Unnao and with a prayer not to arrest the petitioner in pursuance of the impugned FIR. Submission of learned counsel for the petitioner is that the petitioner has been falsely implicated, the F.I.R. contains false averments and the road has been constructed by the petitioner as per the standard, but without making any enquiry, the First Information Report has been lodged against the petitioner. He further submitted that the offences alleged in the FIR carry punishment below seven years, therefore the petitioner is entitled for benefit of Section 41-A of Cr.P.C. as per law laid down by the Supreme Court in the case of Satender Kumar Antil vs Central Bureau of Investigation and Another;
