On an objection raised by Sri Ravi Shankar Mishra, learned counsel for the respondent no.4 that the petitioners have filed an affidavit disclosing therein that the petitioners are languishing in jail therefore this petition itself is not maintainable, Sri Ashish Kumar Singh, Advocate holding brief of Sri Pal Singh Yadav submits that the petitioners are not in jail and inadvertently it has been mentioned in the petition. Therefore this petition may be dismissed as not pressed with liberty to file fresh. He further prays that office may be directed to return the certified copy of the order dated 18.05.2023 annexed as Annexure No.2 to the petition for filing the fresh petition. To which there is no objection by learned A.G.A. and learned counsel for the respondent no.4. In view of above, the petition is dismissed as not pressed with liberty as aforesaid.
