¶1Heard learned counsel appearing for the accused-petitioner and learned Additional Government Advocate appearing for the State.

¶2Present petition under Section 482 Cr.P.C. has been filed seeking quashing of the proceedings of Case No.17215 of 2021 arising out of Charge-sheet No.A216 of 2021 dated 01.09.2021 filed in Case Crime No.110 of 2021 under Sections 420, 467, 468, 471 IPC, Police Station Kotwali Bhinga, District Shrawasti as well as impugned summoning order dated 22.11.2021 and non bailable warrant dated 19.04.2023.

¶3After concluding the investigation charge-sheet was filed on 01.09.2021 and the Court after taking cognizance issued summons to the applicant on

22.11.2021. The accused-petitioner did not answer the summon and, therefore, the Court issued non bailable warrant on 19.04.2023.

¶4This Court finds no ground to interfere with the on going proceedings or charge-sheet, which is based on evidence. Since the petition lacks merit, it is hereby dismissed. However, the petitioner is granted one week's time to surrender before the trial Court and apply for regular bail, and in case the petitioner surrenders before the trial court and applies for bail within a period of one week, his bail application shall be considered expeditiously in accordance with law.
