¶1Heard Mr. R.P. Mishra, learned counsel for the accused-applicant, as well as Mr. Rajesh Singh, learned Additional Government Advocate, on this 2nd application for bail, and gone through the entire record.
¶2The earlier bail application was rejected by the Coordinate Bench vide order dated 09.05.2022 passed in Criminal Misc. Bail Application No.13857 of 2021. After being released by the coordinate Bench, this application has come up before this Court.
¶3By means of this application under Section 439 CrPC, the accused-applicant seeks bail in FIR No.0140 of 2021, under Sections 363 and 376 IPC read with Section 3/4 POCSO Act lodged at Police Station Pachpedwa, District Balrampur.
¶4It appears that the accused-applicant and the prosecutrix were in love relationship; on 27.07.2021, they fled away from the village, and lived together for more than one year in Mumbai.
