Judgment

Court No. - 11 Case :- CRIMINAL REVISION No. - 661 of 2023 Revisionist :- Ram Ratan Opposite Party :- State Of U.P. Thru. Secy. Home Civil Sectt. Lko. And 2 Others Counsel for Revisionist :- Rajendra Singh Counsel for Opposite Party :- G.A. Hon'ble Dinesh Kumar Singh,J.

¶1Heard learned counsel for the revisionist as well as Sri Anurag Varma, learned AGA and perused the record.

¶2The present criminal revision under Section 19(4) of the Family Courts Act has been filed against the order dated 6.6.2023 passed by the learned Additional Principal Judge-I, Lucknow, whereby the application of the revisionist, who is the alleged husband of Smt. Ram Devi, under Section 311 Cr.P.C. has been rejected on the ground that evidence of both the parties got concluded. The case was filed in the year 2013 for maintenance under Section 125 Cr.P.C.

¶3The Family Court also noted that evidence of the complainant was recorded on 24.10.2016 and on the said date, she was cross-examined. Thereafter, on

26.10.2017 she was again cross-examined and on 18.12.2017 she was fully examined. The revisionist was given full opportunity to cross-examine the complainant. Therefore, the application filed by the revisionist was nothing but to linger on the proceedings, which have remained pending since 2013.

¶4In view thereof, this Court does not find that the learned Family Court has not committed any error of law or jurisdiction while rejecting the application of the revisionist.

¶5Thus, present revision being devoid of merit and substance, is hereby dismissed. Order Date :- 20.6.2023 Rao/- High Court of Judicature at Allahabad, Lucknow Bench
