¶1Heard learned counsel for the petitioner and learned Additional Government Advocate for the State.
¶2The present writ petition under Article 226 of the Constitution of India has been filed seeking following reliefs: "(i) To issue writ of Certiorari, thereby quashing the entire proceeding arising out of Crime Case No. 101 of 2023, U/s-307, 120B, 34 I.P.C., P.S.- Baldirai, District-Sultanpur UP against petitioner after calling of record/objection.
(ii) ......................."
¶3The petitioner is specifically named in the F.I.R. on the basis of suspicion. The investigation is still on. This Court does not find that no offence is made out from the reading of the F.I.R. and, therefore, this Court finds no ground to quash the F.I.R. The complainant's daughter was killed the incident. His case is registered under Section 302 I.P.C. The accused-applicant is one of the accused named in the F.I.R.
¶4Considering these facts, we find no ground to quash the impugned F.I.R. Accordingly, this writ petition being devoid of merit and substance, is hereby dismissed. (Syed Qamar Hasan Rizvi, J.)
