¶1Heard learned counsel appearing for the accused-petitioner and learned Additional Government Advocate appearing for the State. Vakalatnama filed by Sri Shachindra Dwivedi, Advocate on behalf of the complainant is taken on record.

¶2Present petition under Section 482 Cr.P.C. has been filed seeking quashing of proceedings of Criminal Case No.7018 of 2023: State vs Umesh Tripathi, arising out of Charge Sheet No.A140 of 2022 dated

28.09.2022 arising out of FIR No.120 of 2022 under Sections 419, 420 IPC, Police Station Bhiti, Ambedkar Nagar.

¶3Learned counsel appearing for the petitioner submits that the petitioner is ready to appear before the trial court and seek bail.

¶4Since the offence entails punishment of less than 7 years, the trial court may enlarge the accused on bail on furnishing personal bond and two sureties to the satisfaction of the trail court.

¶5Considering the aforesaid submissions, the petition is disposed of with liberty to the petitioner-accused to surrender before the trial court within a period of 10 days from today and apply for bail, which shall be considered expeditiously in accordance with law.
