¶1The petitioner's claim for grant of benefit under Pradhan Mantri Avas Yojana has been declined on the ground that she is residing with her father-in-law, who has three rooms pakka house. This report is dated 27.03.2023.

¶2The contention is that the name of the petitioner was included in the list of eligible persons for the year 2021-22 but subsequently, on enquiry it was found that father-in-law with whom she is residing has a pakka house, thus she was found ineligible.

¶3Learned counsel for the petitioner relies upon the extract of the family register and a photograph annexed with the petition to assert that she is residing separately. However, we find that the extract of the family register itself say that the petitioner is residing separately from 24.08.2021. It is not possible for us to adjudicate factual dispute as to whether the petitioner is residing separately with her father-in-law or not. The petitioner may approach the Chief Development Officer, Gonda with proof of separate residence, who may get the facts verified and do the needful as per law within two months.
