¶1Heard learned counsel for the petitioner and learned A.C.S.C. for the State.

¶2The instant petition has been filed with a prayer to issue a writ, order or direction in the nature of mandamus commanding the opposite parties to decide the report dated 31.05.2023 पतततक 26/

उ०जज०अ०/ आपपररर-पसरतव/2023, contained as annexure no.1 to this writ petition.

¶3It is contended by learned counsel for the petitioner that applications regarding complaint for appointment of fair price shop dealers were moved before the Sub Divisional Magistrate, Shahabad, Hardoi dated 31.05.2023, on which he directed the Block Development Officer concerned to make inquiry and submit report within a period of three days but no such report was given by the Block Development Officer concerned, therefore, direction be given to decide the report as called by order dated 31.05.2023 by the Sub Divisional Magistrate.

¶4Learned A.C.S.C. for the State opposed the prayer and urged that in this case complaints were made to the Sub Divisional Magistrate, Shahabad, Hardoi to call for report from the Block Development Officer concerned within a period of three days. He further contended that the petitioner has an option to approach the Sub Divisional Magistrate for non compliance of his direction given to the Block Development Officer concerned.

¶5Considering the facts and circumstances of the case as well as contention made by learned counsel for the parties, the petitioner is directed to approach the Sub Divisional Magistrate, Shahabad, Hardoi for taking necessary action in relation to non compliance of direction as issued on 31.05.2023 to the Block Development Officer concerned. In case report has already been given by the Block Development Officer, he is to take decision on it within fifteen days from today.
