Judgment

Court No. - 8 Case :- WRIT - A No. - 4757 of 2023 Petitioner :- Om Prakash Singh Respondent :- State Of U.P. Thru. Addl. Chief Secy. Home Lko. And 4 Others Counsel for Petitioner :- Mohd Salim Siddiqui Counsel for Respondent :- C.S.C. Hon'ble Dinesh Kumar Singh,J.

¶1Heard Mr. Mohd Salim Siddiqui, learned counsel for the petitioner and Ms.Deepshikha, learned Chief Standing Counsel appearing for the State-respondents.

¶2The present petition under Article 226 of the Constitution of India has been filed seeking quashing of the order dated 17.06.2023 and relieving order dated 25.06.2023 whereby the petitioner has been transferred from his present place of posting in Special Branch, District-Ayodhya to Local Intelligence Unit, District-Kheri.

¶3The only ground which has been taken in the present petition is that the wife of the petitioner is also a Constable and she is posted in District-Ayodhya. It is submitted that transferring the petitioner to a place other than his present place of posting is against the policy decisions of the State Government.

¶4None of the policy decisions of the State Government which have been placed reliance on by learned Counsel for the petitioner mandate posting of husband and wife at one place. It is desirable in the policy decisions that if the husband and wife are in government service, they should be posted at one place.

¶5Be that as it may, this Court is of the view that this writ petition may be disposed of with liberty to the petitioner to approach Additional Director General, Intelligence, Intelligence Headquarters,1, Gokhale Marg, Lucknow, Uttar Pradesh with his grievance within a period of seven days from today, on which the respondent No.2 shall take appropriate decision. However, the petitioner should join at his new place of posting inasmuch as this Court has not interfered with the impugned transfer order and relieving order.

¶6With the aforesaid observations/directions, the present petition finally stands disposed of. (Dinesh Kumar Singh, J.) Order Date :- 4.7.2023 Piyush/- High Court of Judicature at Allahabad, Lucknow Bench
