¶1Heard learned counsel appearing for the accused-petitioner and learned Additional Chief Standing Counsel appearing for the State.

¶2Present petition under Article 226 of the Constitution of India has been filed seeking quashing of the order dated 21.09.2022 passed by District Commandant Home Gaurd, Kheri rejecting application of the petitioner for giving him appointment on compassionate ground after the demise of his father on 01.09.2021 in harness.

¶3The petitioner was physically examined to find out physical standards. The petitioner's height was assessed to be 163.6 cm whereas as per physical standards prescribed for height, minimum height should be 167.7 cm.

¶4I do not find any ground to interfere with the impugned order in exercise of jurisdiction under Article 226 of the Constitution of India.
