¶1The present writ petition under Article 226 of the Constitution of India has been filed seeking a Writ of Certiorari quashing the orders dated 23.11.2001, 22.2.2002 and 4.5.2011 with further prayer for a Writ of Mandamus commanding the opposite parties to consider the case of the petitioner sympathetically for reinstatement in service with all consequential benefits.
¶2This writ petition was initially listed on 12.5.2023, on which date counsel for the petitioner sought adjournment to prepare the matter as he was not ready with the matter on the date of listing. This Court granted four weeks' time to the counsel for the petitioner to get ready with the matter. Thus, the matter was listed yesterday and the counsel for the petitioner sought adjournment on the ground of his ill health and the case was directed to be listed today peremptorily. Despite the case being listed today peremptorily and taken up in revised call, counsel for the petitioner has not appeared to press this writ petition. Therefore, the Court has no option, but to proceed with the matter to decided it on merit with the assistance of Sri S.B. Pandey, learned Assistant Solicitor General of India assisted by Mr. Varun Pandey.
¶3The petitioner, who was employed in Central Reserve Police Force as Constable, was dismissed from service on 23.11.2001. The petitioner has challenged the aforesaid order by way of this writ petition in the year 2023 i.e. after 22 years. This Court does not find any ground to interfere with such a belated petition.
¶4In view thereof, the present writ petition is dismissed on the ground of delay as well as on merit. Order Date :- 5.7.2023 Rao/- High Court of Judicature at Allahabad, Lucknow Bench
