¶1Heard learned counsel appearing for the petitioner and learned Additional Chief Standing Counsel appearing for the State.

¶2Present petition under Article 226 of the Constitution of India has been filed seeking a writ of mandamus commanding the respondents to open the seal cover envelop of departmental promotion committee's proceedings in respect of the promotion of the petitioner to the post of Inspector.

¶3The petitioner is an accused in the FIR No.0726 of 2020 initially registered under Sections 302, 120B, 506 IPC, Police Station Kotwali, District Unnao, however in the aforesaid offence, after investigation, charge-sheet has been filed under Section 302 IPC.

¶4As the petitioner is facing criminal trial of heinous offence, proceedings in respect of his promotion have been kept in a sealed cover as provided in the Government Order dated 28.05.1997. I find no reason to direct the respondents to open the seal cover during the pendency of the aforesaid criminal case against the petitioner.
