Court No. - 8 Case :- WRIT - A No. - 4784 of 2023 Petitioner :- Yuvraj Singh (C.R.P.F. No. 105181281) Respondent :- Union Of India, Thru. Secy., Ministry Of Home Affairs New Delhi And 2 Others Counsel for Petitioner :- Avinash Tiwari Counsel for Respondent :- A.S.G.I. Hon'ble Dinesh Kumar Singh,J.
¶1Heard Shri Avinash Tiwari, learned counsel for the petitioner and Shri S.B. Pandey, learned Senior Advocate (Deputy Solicitor General of India) assisted by Shri Varun Pandey, learned Counsel appearing on behalf of respondents.
¶2The present petition under Article 226 of the Constitution of India has been filed aggrieved by the order dated 19.06.2023 passed by the Deputy Inspector General, Central Reserve Police Force, Lucknow Range, Lucknow whereby petitioner's application for voluntary retirement dated 19.06.2023 has been rejected on the ground that the petitioner had made allegations in the said application that he had been tortured, harassed and discriminated on the ground of his caste for which he has suffered immensely, therefore, he would not like to continue in service.
¶3The Deputy Inspector General, Central Reserve Police Force, Lucknow Range, Lucknow has taken a view that the application moved by the petitioner contains serious allegations against the officials of the department, and therefore, rejected the same being not simplicitor for acceptance, but conditional one.
¶4Considering the aforesaid facts, I do not find that the impugned order suffers from any illegality which requires an interference by this Court in its extraordinary writ jurisdiction.
¶5In view thereof, the present petition is hereby dismissed. However, if the petitioner moves a simplicitor application for resigning from the department i.e. Central Reserve Police Force, the competent authority may take an appropriate decision on the said application.
