Judgment
Court No. - 8 Case :- CRIMINAL MISC. BAIL APPLICATION No. - 8609 of 2023 Applicant :- Rakesh Lodh Opposite Party :- State Of U.P. Thru. Prin. Secy. Home Civil Secrett. Lko. Counsel for Applicant :- Dheeraj Awasthi Counsel for Opposite Party :- G.A. Hon'ble Dinesh Kumar Singh,J. Heard learned counsel appearing for the accused-applicant and learned A.G.A. for the State. This is second bail application which has been filed seeking bail in FIR No.108 of 2019 under Sections 302, 201, 120B IPC, Police Station Makhi, District Unnao. First bail application has been rejected by this Court vide order dated
29.09.2022 passed in Bail No.3692 of 2021 by following order:- "1. Heard learned counsel for the accused-applicant as well as learned Additional Government Advocate and gone through the entire record.
¶2By means of this application under Section 439 CrPC, the accused-applicant seeks bail in FIR No.0108 of 2019, under Sections 302, 201 and 120B IPC lodged at Police Station Makhi, District Unnao.
¶3Allegation against the accused-applicant is of killing his own daughter and disposing of her body; reason for committing murder of his own daughter is her relation with Satendra, who was also killed; it is alleged to be a case of honour killing; four witnesses of fat have already been examined. Considering heinousness of the offence, evidence available on record, the fact that the trial is going on where four witnesses of fact have already been examined, this Court does not find it a case for bail. Hence, the bail plea is refused and the application is rejected. However, considering incarceration of the accused applicant in jail since 19.05.2019 pending trial, the learned trial Court is directed to proceed with the trial and conclude the same expeditiously, say within a period of six months from the date certified copy of this order is submitted/served, subject to full cooperation of the accused-applicant." I do not find any change circumstance to enlarge the accused-applicant on bail at this stage. This bail application is rejected. (Dinesh Kumar Singh, J.)
