Court No. - 8 Case :- WRIT - A No. - 7235 of 2015 Petitioner :- Shishir Kumar And 3 Ors. Respondent :- State Of U.P. Thru Its Prin.Secy.Deptt.Of Medical Edu.And Ors. Counsel for Petitioner :- Suresh Chandra Verma Counsel for Respondent :- C.S.C. Hon'ble Dinesh Kumar Singh,J.
¶1Heard Shri Suresh Chandra Verma, learned counsel for the petitioners and Shri Aditya Dwivedi, learned Standing Counsel appearing for the State-respondents.
¶2The present petition under Article 226 of the Constitution of India has been filed seeking quashing of the impugned letter dated
24.02.2014 and order dated 26.02.2014 passed by the opposite party Nos.1 & 2 whereby engagement of the petitioners as Sweeper has been terminated.
¶3The petitioners were employed as part time Sweeper. On
25.11.2010, it was found that the employment of the petitioners as part time Sweeper was against the relevant directions/government orders and therefore, vide impugned order dated 26.02.2014 the engagement of the petitioners as part time sweeper was cancelled.
¶4This Court finds nothing wrong in the impugned order. The petitioners cannot claim permanency on the post of Sweeper as they were not substantially appointed and their engagement was only on part time basis.
¶5Therefore, no relief as sought for in this writ petition can be granted to the petitioners. The writ petition being devoid of merit and substance is hereby dismissed. (Dinesh Kumar Singh, J.) Order Date :- 12.7.2023 Piyush/- High Court of Judicature at Allahabad, Lucknow Bench
