Judgment
Court No. - 8 Case :- WRIT - A No. - 9523 of 2019 Petitioner :- Ashok Yadav Respondent :- State Of U.P. Thru. Prin. Secy. Govt. Of U.P. And Ors. Counsel for Petitioner :- Satyendra Kumar Tiwari Counsel for Respondent :- C.S.C. Hon'ble Dinesh Kumar Singh,J.
¶1Heard Shri Satyendra Kumar Tiwari, learned counsel for the petitioner and Shri Pankaj Kumar Srivastava, learned Additional chief Standing Counsel appearing for the State-respondents.
¶2The present petition under Article 226 of the Constitution of India has been filed for writ of mandamus commanding the respondents to declare the petitioner selected and direction to give him appointment on the post of P.A.C. (Male) Constable in the Other Backward Classes category.
¶3In pursuance to the advertisement issued on 29.09.2015 the petitioner applied under the Other Backward Classes category for the post of Constable in Civil Police and P.A.C. in the State of Uttar Pradesh. The petitioner secured 397.2 marks in the written examination. However, the petitioner could not submit the certificate of him belonging to the Other Backward Classes category. The petitioner's candidature was therefore, considered against the vacancy meant for general category candidates. The cut of marks for the general category candidates was 403.06 and the petitioner had secured only 397.2 marks, therefore, his selection was not made either against the vacancy meant for general category candidates. The petitioner submitted his caste certificate after the last date of submission of the certificate and therefore, his candidature was also not considered against the vacancy reserved for Other Backward Classes category candidates.
¶4Considering the aforesaid facts, I find no substance in this petition. The sanctity involved in the selection process cannot be allowed to remain open after the due date, therefore, this writ petition fails, which is hereby dismissed. (Dinesh Kumar Singh, J.)
