¶1Heard Mr. M.P. Raju, learned counsel for the petitioner, as well as Mr. Jogendranath Vemra, learned Standing Counsel for the respondent-State Authorities.

¶2The petitioner has filed this petition under Article 226 of the Constitution of India, impugning the order dated 7th May, 2023 whereby he has been transferred from Cyber Crime, Headquarters to Civil Police and posted at Mau.

¶3On request made by the petitioner, he was made to join in Cyber Crime at Agra. It appears that there were certain complaints against the petitioner, while he was posted in Cyber Crime of the U.P. Police at Agra. Those complaints were enquired into, and the petitioner was found guilty for misconduct for which he has been awarded punishment of censure entry. The petitioner was thereafter transferred to Headquarters from Agra, and in the light of Circular regarding posting in Cyber Crime, the petitioner has been sent back to the Civil Police. The new posting of the petitioner at Civil Police is not a transfer, rather he has been repatriated because of certain misconducts, allegedly committed by him.
