Judgment

Court No. - 8 Case :- WRIT - A No. - 28404 of 2018 Petitioner :- Naresh Singh Senior Citizen Respondent :- State Of U.P. Thru Prin.Secy. Revenue Lucknow And Ors. Counsel for Petitioner :- Rajesh Kumar Singh Counsel for Respondent :- C.S.C.,Dipak Seth Hon'ble Dinesh Kumar Singh,J.

¶1Heard Sri Rajesh Kumar Singh, learned counsel or the petitioner and Sri Sandeep Chandra, Learned Standing Counsel and Ms. Harshita, learned counsel appearing for opposite party no.2.

¶2The present writ petition under Article 226 of the Constitution of India has been filed for interest @18% per annum on GPF amount of the petitioner amounting to Rs.7,340/- since 1984.

¶3The petitioner was compulsorily retired in the year 1983. Out of Rs.7,340/-, only Rs.5,900/- was paid to the petitioner only on

16.3.2012. However, a sum of Rs.1,440/- was paid to the petitioner on 21.8.2021.

¶4The poor petitioner has been fighting for this meager amount of Rs.7,340/- since 1984. 28 years after the date of his retirement, the petitioner was paid an meager amount of Rs.5,900/- and the remaining amount of Rs.1,440/- was paid to the petitioner on 21.8.2021.

¶5This Court is shock with the treatment meted out the petitioner by the department. It has shaken the conscience of the Court to find out that even for a meager amount of Rs.5,900/-, the petitioner has to wait for 28 long years and the remaining amount has been paid to him in the year 2021 i.e. after 38 years and that too without any interest on the delayed payment of GPF.

¶6Considering the gross injustice meted out the petitioner, opposite parties are directed to pay Rs.50,000/- to the petitioner as lump-sum interest on the delayed payment of GPF to the petitioner. The said amount must be paid to the petitioner within a period of four weeks from today.

¶7Let a copy of this order be communicated by Sri Sandeep Chandra, learned Standing Counsel to the concerned authority forthwith for necessary compliance.

¶8Subject to above noted terms, the present writ petition is allowed. Order Date :- 13.7.2023 Rao/- High Court of Judicature at Allahabad, Lucknow Bench
