¶1Despite the matter being listed peremptorily, learned counsel for the petitioner is not present, though Mr. Raj Kumar Upadhyaya, learned counsel for respondent - U.P. Public Service Commission, and Mr. Ram Pratap Singh Chauhan, learned Additional Chief Standing Counsel for respondent - State Authorities, are present to assist the Court. With their assistance, this Court proceeds to decide this petition.

¶2By way of this petition under Article 226 of the Constitution of India the petitioner has challenged the order dated

29.08.2014 and the consequential order dated 26.09.2014 whereby he has been communicated that in view of provisions of the U.P. Government Department Statistics Rules, 2012 his claim for promotion under the rescind Rules of 1993 cannot be accepted.

¶3Once the service condition of the petitioner is governed by the Rules of 2012 and not by the Rules of 1993, the claim of the petitioner, in this petition, is wholly misconceived.
