Shri Satish Kumar Sharma, learned counsel for the petitioner contends that no fair price shop dealership has been appointed in the village panchayat Sisora Nasir, Tehsil Mohammadi, District Lakhimpur Kheri for the past 10 years on account of pendency of the litigation. The writ petition filed by the erstwhile fair price shop dealership whose license was cancelled on account of irregularities, has been dismissed for non prosecution by order dated 12.05.2023 rendered by this Court in Writ C No. 8151 of 2013 (Mansoor Khan Vs. State of U.P. and others). The petitioner claims to be a ration card holder who is facing hardships as the shop has been attached to a nearby village. Fair price shop dealerships are created in the interest of the most deprived and vulnerable sections of the society. The endeavour of the authorities as well as the courts should be to decide these matters earliest so that the sections for which the benefit is intended do not suffer. In this wake, the Sub Divisional Magistrate, Tehsil Mohammadi, Lakhimpur Kheri as well as Gaon Sabha are directed to ensure the appointment of a new fair price shop dealership in the said village within a period of one month from the date of receipt of a certified copy of this order.
